On April 28, 2026, during a House Judiciary Subcommittee on the Constitution and Limited Government hearing titled “From Tool to Weapon: The FACE Act and the Dangers of Federalizing Criminal Law,” Rep. Brandon Gill (R-TX) questioned witness Jessica Waters, a Senior Scholar in Residence in Justice, Law & Criminology at American University’s School of Public Affairs.
The hearing focused on the Freedom of Access to Clinic Entrances (FACE) Act.
Rep. Gill asked Waters directly, “What is your favorite type of abortion?” When she declined to answer and instead pivoted to patients’ access to reproductive health care, he proceeded to describe several common abortion procedures in graphic detail—including suction aspiration, dilation and curettage (D&C), and dilation and evacuation (D&E). Waters appeared visibly uncomfortable during the exchange.
