Contra Costa Superior Court Judge Nichelle Holmes (appointed by Gov. Gavin Newsom in 2024) ordered Marcos Iriarte-Valdez, 36, released on his own recognizance on August 5, 2026. This followed his arrest the day before for allegedly violating home-detention terms while on pretrial release for residential burglary charges (Orinda, April 2026, involving occupied homes).
The next day (August 6), Iriarte-Valdez fatally stabbed 68-year-old Todd Stewart during an attempted burglary at Stewart’s Martinez home. He was arrested days later, charged with special-circumstance murder (while fleeing a burglary), and has been held without bail after pleading not guilty. DHS has identified him as a Venezuelan illegal alien who had been in the U.S. since around 2007, with a prior criminal record including burglaries and other offenses. California’s sanctuary policies limited ICE cooperation.
